GapWatch Privacy Policy

This Privacy Policy describes how GapWatch LLC, a Florida limited liability company ("GapWatch," "we," "us," or "our"), collects, uses, and shares information in connection with the GapWatch platform, websites, dashboards, alerts, reports, and related services (collectively, the "Services"). By accessing or using the Services, you acknowledge this Privacy Policy. If you are using the Services on behalf of an organization that has entered into a Master Services Agreement ("MSA") with GapWatch, this Privacy Policy supplements, and does not replace, the confidentiality and data protection terms of that agreement; in the event of a conflict, the MSA controls.

1. Information We Collect

Account Information. When an account is created for you or your organization, we collect information such as name, business name, job title, email address, phone number, mailing address, and login credentials.

Payment Information. We collect billing details such as billing contact, billing address, and payment method information. Payment card and bank account (ACH) details are collected and processed by our payment processor, Stripe, Inc. GapWatch does not store full payment card numbers or bank account numbers on its own systems.

Transaction and Property Information. In the course of providing the Services, we collect and process information about the properties, transactions, and loans you ask us to monitor, such as property addresses, parcel identifiers, party names appearing in public records, recording information, lien and mortgage information, and property tax status.

Public Records Information. The Services monitor publicly available records maintained by counties, clerks of court, official records systems, and similar governmental and quasi-governmental sources. Information obtained from these sources is public record information and is not collected from you.

Usage and Device Information. We automatically collect certain technical information when you use the Services, such as IP address, browser type, device information, pages viewed, actions taken within the platform, and access dates and times. We use cookies and similar technologies to keep you signed in and to operate the Services.

Communications. We collect the contents of communications you send to us, such as support requests and email correspondence.

2. How We Use Information

We use the information we collect to: (a) provide, operate, maintain, and secure the Services, including monitoring the properties, transactions, and loans you designate; (b) generate alerts, notices, reports, and certificates; (c) process payments and manage billing; (d) provide customer support; (e) communicate with you about the Services, including service and security notices; (f) analyze and improve the Services, including through the use of automated and artificial intelligence tools that assist in analyzing public record documents; (g) enforce our agreements and protect our legal rights; and (h) comply with applicable law.

We do not sell your personal information, and we do not share your personal information with third parties for their own marketing purposes.

3. How We Share Information

Service Providers. We share information with vendors who perform services on our behalf, including: Stripe (payment processing); email delivery providers (transactional emails and alerts); cloud hosting and data storage providers; and artificial intelligence service providers used to assist in analyzing public record documents. These providers are permitted to use the information only to perform services for us.

Public Record Sources. When performing searches and monitoring, we submit query information (such as property identifiers and party names) to county and clerk record systems and similar public record sources.

Legal Requirements. We may disclose information if required to do so by law, subpoena, or court order, or where we believe disclosure is necessary to protect our rights, your safety, or the safety of others, or to detect and prevent fraud or security issues.

Business Transfers. If GapWatch is involved in a merger, acquisition, financing, or sale of all or a portion of its business or assets, information may be transferred as part of that transaction, subject to this Privacy Policy.

With Your Direction. We share information when you direct us to, such as when you authorize integrations with your own software systems.

4. Data Security

We maintain administrative, technical, and physical safeguards designed to protect information under our control, including encryption in transit, access controls, and authentication requirements. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

5. Data Retention

We retain information for as long as reasonably necessary to provide the Services, comply with our legal and contractual obligations, resolve disputes, maintain audit records, and enforce our agreements. Monitoring records and audit logs may be retained after monitoring ends where necessary for these purposes. Public record information remains subject to the retention practices of its governmental sources.

6. Your Choices and Rights

Depending on where you reside, you may have rights under applicable privacy laws (such as the California Consumer Privacy Act or similar state laws), including the right to know what personal information we hold about you, to request correction or deletion of your personal information, and to not be discriminated against for exercising these rights. Because GapWatch monitors public records, rights to deletion do not extend to information contained in governmental public record systems, which GapWatch does not control.

To exercise any of these rights, or to update your account information, contact us using the information in Section 10. We will respond as required by applicable law and may need to verify your identity before acting on a request.

Email Preferences. Service and security notices are a necessary part of the Services and cannot be opted out of while you maintain an account. You may opt out of any marketing communications by following the unsubscribe instructions in those messages.

7. Children's Privacy

The Services are business tools intended for use by real estate, lending, and legal professionals. The Services are not directed to children, and we do not knowingly collect personal information from anyone under eighteen (18) years of age.

8. Third-Party Sites and Sources

The Services may contain links to third-party websites, including county and clerk record systems. This Privacy Policy does not apply to those websites, and we are not responsible for their content or privacy practices.

9. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by posting the updated policy with a new "Last Updated" date and, where appropriate, by additional notice such as email. Your continued use of the Services after the updated policy takes effect constitutes acknowledgment of the updated policy.
